Actually, I'll bet that's the only thing they have to argue: that due to the sponsorship mechanism, YTMND and its users are engaging in commercial speech, and are therefore liable to the laws on trademark dilution. I don't think that argument will be too successful, should Sega Europe actually go as far as they can with this, but I think it's what they'll argue.
