Well folks, it's that time of year again.
Sega is trying to take away your first amendment rights to make fun of their furry little characters.
Read the full legal notice here: www.ytmnd.com/info/legal/sonic.pdf
I think the best part about the letter is the footer on the lawyer's email:

My legal assistant DZK has already penned up a response available here: http://ytmndsega.ytmnsfw.com/.
I am looking into it further, in the mean time, feel free to let Sega know how much you all appreciate them shitting on their target audience.
Cheers!

Quote: "GUYS LET ME STATE THIS AGAIN: There is NO MENTION OF SEGA OF AMERICA OR SEGA OF
JAPAN. This is COMPLETELY SEGA of Europe's doing. If SEGA of America and SEGA of
Japan gave them legal consent, then WAGE WAR. If not then ONLY WAGE WAR ON SEGA OF
EUROPE"
Most campanies that have regional devisions know better than to go against thier own company. Most executives worth thier salt will not, nor will ever, argue with decisions made by another branch of the company less they want to get fired.

They wouldn't exactly be going against them, they'd just have nothing to do with it...

True, however the origional person I quoted stated getting SEGA of Japan or America involved as well. That'd only result in either branch supporting Europe's decision. I'm merely replying to the idea he/she seems to be spamming :)
Why SEGA-Europe, sent from UK, and not SEGA-USA ? ... That's the whole point, baby. Different laws. (from http://news.bbc.co.uk/1/hi/technology/5230776.stm): "Under the law in countries such as Canada, the UK, and Australia, intermediaries can face potential liability for failing to remove allegedly defamatory content once they have received notification of such a claim, even without court oversight. " (con't)
"Indeed, several recent cases in the UK and Australia involving Dow Jones, a US publisher, have sent a strong message that intermediaries ignore defamation claims at their peril. [T]he United States enacted a law 10 years ago that provides broad immunity for intermediaries that host third-party content. That provision has since been used dozens of times to immunize ISPs, large companies such as Amazon.com, and small websites who could ill-afford to fight legal challenges. " ...
Now, check THIS out: "The Supreme Court of Canada has set a high threshold to determine when a party 'authorises' infringement. Merely hosting content, even after being made aware of an unproven infringement allegation, is unlikely to meet that standard." ... Possible solution, then: host YTMND server in Canada, enjoy the sweet maple syrup of freedom.
"What's wrong with it being hosted in the US where it has the same freedoms? " ... What I took from that article is that Canadian law sets a higher threshold of responsibility of "intermediary" sites like YTMND for their hosted content, so less hassle from The Man - I'm kind of being tounge-in-cheek in suggesting a server hosted in Canada, but who knows...
