I almost feel bad for you not getting any real responses here. So how's this - why don't you like the NEDM fad (being as you downvoted my NEDM site). I can't vote 1 star without telling the creator why I was disappointed. Whetstone has as much a right as anyone to make YTMNDs, and you know that full-well. You also know that you have the right to not view a YTMND, and therefore there is no unjust imposition of anyone's religious beliefs. Do you have sources for your "quotes" from Max, or are these just a series of unsubstanciated claims? From a legal standpoint, no laws have been broken by either of you. However, if Whetstone's identity was revealed and sites such as these continued to be made, the creator would be risking a harassment and/or slander and/or libel lawsuit.

at any rate, it's not like the only two possible options are creationism and evolutionary science. there is a grey area. current theories on evolutions are founded on some facts and some speculation, mixed with a lot of logical reasoning. evolutionary theory as we know it today might turn out to be a very sketchy version of what we will find out, in the future, to be a more accurate theory. at one time the Earth was the center of the universe... then it was the sun. we all know now, it is actually neither.
