I am sorry but I have to say this, singular acts of aggression against embaumsworld is possibly the only way to reach them. Their lawyers are sleaze and their name must be ruined. If their stock is traded, it just plummeted. Eat human feces and die ebaums.

Bauman's e-mails were nothing more than a feeble shot at ridiculing our community with an attempted level of formality that looked ridiculously out of place, which is why he encouraged Max to display it publicly. He's only further representing Ebaum's site as the indescent farce it's already renowned to be. Although it's needless to say, I say this only as a re-enforcement of the fact that Max is in the justified position here and has nothing to fear.

On some other forums I've been browsing, they're mentioning sending mail to eBaum's advertisers basically saying that their property was stolen by eBaum and since purchased advertisement space, they no longer will use the products from aforementioned company. A hard copy letter would have much more effect than email here. Anyway, one of the advertisers that perked my interest in such matters was USANetwork. A big name company that would be hurt by bad publicity.

It's not a legal contract, dynthug. It's just one gentleman's honest offer to another. The wording doesn't have to be technical - it just has to convey meaning. What is the underlying meaning? Delete the Lohan facial YTMND content and Max will delete EBaum's YTMNDs.

Since so many of Ebaums forum's state something like "show us your copyright papers" maybe they should read what the loving people at wipo say http://www.wipo.int/copyright/en/faq/faqs.htm it basicly states "Copyright itself does not depend on official procedures. A created work is considered protected by copyright as soon as it exists. According to the Berne Convention for the Protection of Literary and Artistic Works, literary and artistic works are protected without any formalities in the countries party to that Convention. Thus, WIPO does not offer any kind of copyright registration system." so um yea, ebaums members = pwned :D

As long as users can still access unauthorized content from his servers, ebaum has not complied.

Gee Max. Last time I checked my Ph.D was still valid. I'm hardly a kid too! I don't know if the FBI has a "Cyber-Terrorism Unit" as named by Ebaums, but they do investigate internet death threats, hacking, fraud, and other types of crimes and take them very seriously. I have worked with this particular unit in a court case and you will find them very professional and very thorough. If they contact you just be honest. From what I remember, individuals who post death threats and hack may be the ones prosecuted, not you. Individuals who have done real damage, if any, may need to be concerned, but I think you are not a target of prosecution. The case I was involved with was a death threat posted on an AOL message board. AOL was not charged, but representatives did have to testify. But the person who posted it was convicted. Ebaum's letter is hardly a professional response and it may or may not be truthful about the FBI interest, but I think you are in the clear. Good Luck! YTMND rocks!

Oh, and as much as i supported people sending e-mails to the ebaum's host reporting theft of intellectual property, trespassing IS taking it way too far.

You guys all know the details of the 'visit to the headquarters' right? Two kids realized they lived near the headquarters. They didn't know where it was, so they LOOKED IT UP in the phonebook. They documented the visit with pictures. (They said the 'headquarters' just looked like a normal house, nothing fancy) They taped 2 signs to the door, took a picture, removed the signs, and left. Ebaum makes it seem like kids came to the headquarters and took a dump on his doorstep. Every step along the way they manage to make themselves look worse. I don't understand. Max, I commend you for your response here. Did you purposefully word your ultimatum that way? Either way, it resulted in the original html being removed, and an ever more childest rebuttal.

Even though they immediately removed the signs, (no harm, no foul) some gamespot forum members proceeded to find one of their addresses, and harass them. They then immediately apologized to Ebaum. (I am not sure what there was to apologize for...) So yeah, its all bs on that front.

well done max. it really angers me that the ebaum does have a pack of lawyers ready just in case someone decides to go after him. i'm not going to pretend to be versed in the law, but couldn't someone potentially open a class-action civil suit against ebaum? like, anyone who could prove they created content on their site gets a percentage of his ad revenue?

But, I would however add disclaimers along the lines of "The ideas, images, etc. expressed on this websige do not represent the position blah blah blah of YTMND... etc. etc. etc..) Additionally, maybe a "terms of use" or something before seeing the home page that the user must agree to forfeit all rights.. blah blah blah... something along those lines... just a thought...
