Exactly. I'm all for using stolen material. Because, like I said, I respect the artistic validity of it. I think stolen art is a fantastic creation, and I think recontextualizing it is important. But let's not be litigious DMCA douchebags over stuff that we stole ourselves. I've said it before, but destroy ebaums because they suck sh*t. Not because they steal.

Legally speaking, I wouldn't care to postulate on Eric Bauman's practices or anyone else's for that matter, as I am not qualified. One must assume however that since its been stated that he has a "team of lawyers" that someone has challenged him before in a legal arena and failed. So legally he is probably in the clear somehow, even though there is no doubt he is a douschebag and almost universally hated. A successful legal assault against ebaums could backfire on YTMND considerably.

granted, the ORIGINAL ORIGINAL picture is of course sold, after the "picutree" signs a release allowing his/her image to be used, once that image hits a magazine, its free for us, AS long as u dont take watermark it, like ebaum. you dont have to give credit to anyone for it. but, if that picture was never sold, it would be stealing. say i went to some photographers house and took some pictures he had of trebek, and made a ytmnd outta it, that would be stealing, if he had sold the pic to a site or magazine or w/e and i made the ytmnd, not stealing, its the entertainment world, its how it works

What Ebaum's did isn't so much copyright infringement ( - with regards to lohanfacial - ....ymntd is in fact guilty of copyright infringement as well. In terms of many of the music and images it uses) but more guilty of stealing another "comedian's joke". It's in bad taste to do so, and all your peers will hate you for it, but I probably can take you to court over it.

I agree attacking the site was wrong, to an extent, but it's no different than using mal code to bring up pages from www.somethingawful.com on their front page to kill SA's bandwidth. I am 100% behind the "shut down eBaums" cause, but doing anything illegal won't get us anywhere, and may even strengthen his position. In the end we've accomplished nothing, sadly, but we can have the pride in knowing that we've done what no one has been able to do in the course of history, and that is get something removed from eBaums by request. it's sad it took thousands of pissed off people for them to do it.

Nein. For starters, the fact that the pictures are not original is not relevant: plenty of art is made from recycled material showing original company logos and such. It's re-used in a different way. But most importantly: it was the animated GIF that was stolen, not the individual pictures. The guy who made it had an idea and put effort into positioning and animating them in such a way that it looks the way it looks. -That- is wat the picture is about, it's SpliceVW's work, and -that- is what eBaum stole.
