I'm going to have to say, though, that things are different with livejasmin.com and the Church of Scientology, because the Church of Scientology is a nationally recognized name, and injects itself into the public eye willingly, whereas livejasmin is a private company who does not have that national recognition.
Yah, I'm sure he took the picture of the orangutans drinking beer himself, that's not a (c)-violation. And he's setting himself up as the champion of decent, hard-working girls and a wealthy powerful corporate executive, when he's basically a cam-whore pimp and pr0n-merchant. Yeah, it's amazing how all those who threaten YTMND go for the insult first: "children," "kids," "living in parents' basement,"... "We're gonna sue your parents and you'll get a spanking !" ...
Dear BionicKitty...do you realize that YTMND users are asking (and in some cases PAYING) the girls @ your multimillion dollar STRIP/PORN/FETISH site to do things that are literally THOUANDS of times more wholesome and acceptable than they've been asked to do since they signed up for slavery...erm...employment with your company? Think about it...you're pissed off at people asking girls NOT to spread their vagina into a webcam. Please, go kill yourself now.
What's interesting is that many SOH YTMND makers actually PAID for the pvt time, so by the (c) "first-sale" doctrine, they have the right to give away the images however they see fit. Also, the girls are independent contractors using THEIR computers/cameras, and livejasmin.com takes a cut - so who owns the images ? That damages their claim that they're works-for-hire. (Of course, I'm talking just of the screencaps of the girls, NOT the surrounding website design which IS unarguably their (c).)
The same rule that came into play with scientology plays here we took their logo and used it, but not in a commercial venture,,not actionalble. If it were YTMND would be sued by coke, pepsi, burger king, Paramount Studios, NBC,HBO ect,ect,ect. And Max was right a forum post is hardly a "Epic" legal manuver
